1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Catch Select website, consultations, matchmaking and introduction services, membership services, events, social experiences and any other services offered by Catch Select ("Catch Select", "we", "us" or "our").

By accessing or using our website, submitting an enquiry, requesting or attending a consultation, completing an application, applying for membership, purchasing or using our services, attending an event, or otherwise engaging with Catch Select, you agree to these Terms to the extent applicable to your interaction with us.

These Terms should be read together with our Privacy Policy and any additional service agreement, membership agreement, booking terms, package terms, event terms or other written conditions that apply to a particular service.

If there is an inconsistency between these Terms and a specific written agreement relating to a service you have purchased, the specific written agreement will prevail to the extent of the inconsistency.

Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.

 

2. About Our Services

Catch Select provides personalised matchmaking and introduction services for adults seeking meaningful relationships and connections.

Depending on the service selected, our services may include:

• consultations and assessments;

• profile development;

• consideration of your preferences, values, personality, lifestyle, interests and relationship goals;

• personalised matchmaking;

• introductions to potentially compatible individuals;

• feedback and profile adjustments;

• dating or relationship-related guidance;

• membership benefits;

• member events and social experiences; and

• other services agreed between you and Catch Select.

The specific services, inclusions, duration, fees, conditions and limitations applicable to you will depend on the service, package or arrangement you select.

Catch Select may change, improve, suspend or discontinue particular services from time to time, subject to any existing contractual commitments and applicable law.

 

3. Eligibility

To participate in Catch Select's matchmaking or member services, you must:

• be at least 18 years of age;

• be legally capable of entering into a binding agreement;

• provide information that is accurate, current and not misleading to the best of your knowledge;

• not impersonate another person;

• not provide false, fraudulent or misleading documents or information;

• comply with these Terms and any applicable service-specific terms;

• comply with reasonable requirements communicated by Catch Select; and

• participate respectfully, safely and lawfully.

Catch Select may decline an application, membership or service request where permitted by law and where we reasonably consider this necessary for safety, suitability, operational, legal or legitimate business reasons.

Acceptance into a Catch Select service or membership is not automatic.

 

4. Consultation and Application

Submitting a consultation request, attending a consultation, completing an application or providing information to Catch Select does not guarantee acceptance as a Catch Select client or member.

The consultation and application process may be used to:

• learn more about you;

• explain our services;

• assess whether a particular service may be appropriate;

• determine whether Catch Select is willing and able to provide services; and

• discuss available service options.

Unless otherwise agreed in writing, attending a consultation does not require either you or Catch Select to proceed with a paid service.

Catch Select may decline an application or decide not to offer a particular service, subject to applicable law.

Catch Select is not required to disclose confidential information about another applicant or participant, or provide detailed reasons for every decision relating to acceptance, matchmaking or introductions.

 

5. Your Information and Profile

You are responsible for ensuring that information you provide to Catch Select is accurate, current and complete to the best of your knowledge.

This information may include details relating to your:

• identity and age;

• relationship status;

• occupation or professional background;

• lifestyle;

• interests;

• preferences;

• values;

• personality;

• relationship goals; and

• other information reasonably relevant to the provision of our services.

You must notify Catch Select as soon as reasonably practicable if information you have provided materially changes or is no longer accurate.

Catch Select may rely on information supplied by you when considering your application, developing your profile and providing matchmaking services.

You acknowledge that inaccurate, incomplete, outdated or misleading information may affect:

• your eligibility;

• the suitability of potential introductions;

• our ability to provide services;

• the accuracy of your profile; and

• your continued participation in Catch Select.

We may suspend, restrict or terminate services where we reasonably believe that material information provided by you is false, misleading, fraudulent or no longer accurate.

 

6. Verification and Background Information

Catch Select may request information or documentation as part of our onboarding, verification or ongoing service processes.

Depending on the circumstances, this may include information or documentation relating to:

• identity;

• age;

• employment or occupational status;

• relationship status;

• police clearances or other background-related documentation, where requested;

• photographs or identity documents; and

• other information reasonably relevant to participation in our services.

You agree to provide requested information honestly and only provide documents or information that you are authorised to provide.

Important Verification Disclaimer

Our verification processes may vary depending on the individual, service and circumstances.

Unless expressly stated otherwise in writing, Catch Select does not represent or guarantee that every participant has undergone a comprehensive:

• criminal history check;

• police background check;

• identity check;

• financial background check;

• employment verification;

• relationship-status verification; or

• other background or safety screening process.

The term "verified" may refer only to the specific information or documentation reviewed or confirmed by Catch Select as part of our applicable process. It does not mean that Catch Select has independently investigated every aspect of a person's identity, history, character, conduct, intentions, safety, financial circumstances, relationship history or suitability.

Verification, documentation or a police clearance does not guarantee that a person:

• has no criminal history;

• presents no risk;

• is safe;

• is honest in all circumstances;

• will behave appropriately;

• will remain single;

• is compatible with you; or

• will act in accordance with their stated intentions.

You remain responsible for exercising your own judgment and taking appropriate precautions when communicating with or meeting another person.

Catch Select may refuse, suspend or discontinue participation where requested information is not provided, cannot reasonably be verified, appears misleading or gives rise to legitimate concerns relevant to participation in our services.

7. Matchmaking and Introductions

Catch Select considers a range of factors when identifying potential introductions. These may include:

• personal preferences;

• relationship goals;

• values;

• personality;

• lifestyle;

• interests;

• location;

• availability; and

• other factors we reasonably consider relevant.

Matchmaking is inherently personal and subjective. Catch Select may consider factors beyond a simple checklist and retains discretion in determining whether to propose, facilitate or decline a potential introduction.

An introduction may involve, depending on the applicable service:

• sharing agreed profile information;

• facilitating contact between two mutually willing individuals;

• exchanging agreed contact details;

• arranging an initial meeting or introduction; or

• another method of connecting participants agreed by Catch Select.

The specific meaning of an "Introduction" for a paid service or package may be further defined in the applicable service agreement or package terms.

Unless otherwise expressly agreed in writing, Catch Select is not required to:

• introduce you to a specific person;

• provide introductions at a particular frequency;

• satisfy every stated preference;

• continue proposing introductions that you decline;

• provide a replacement introduction in every circumstance; or

• disclose the reasons why a particular person has not been proposed to you.

Before facilitating an introduction, Catch Select may seek confirmation from each relevant participant that they are willing to proceed.

Either person may decline a proposed introduction.

Catch Select may decide not to proceed with a proposed introduction or may withdraw an introduction where we reasonably consider this appropriate for privacy, safety, suitability, operational or other legitimate reasons.

8. No Guarantee of Results

While Catch Select aims to provide a personalised and professional service, matchmaking and relationships involve personal choices and circumstances that are outside our control.

Unless expressly agreed otherwise in writing, Catch Select does not guarantee:

• that a suitable match will be available;

• that you will receive a particular number of introductions;

• that introductions will occur within a particular timeframe;

• that all of your preferences will be met;

• that a proposed introduction will proceed;

• that another person will respond to you;

• mutual attraction or interest;

• a successful date;

• an ongoing relationship;

• marriage, cohabitation or any other relationship outcome.

The availability and timing of potential introductions may depend on factors outside Catch Select's control, including the availability of potentially suitable and mutually interested individuals.

Payment for a Catch Select service is payment for the agreed service and effort involved in providing that service. It is not a guarantee that a particular relationship outcome will be achieved.

9. Your Interactions with Other Participants

Any interaction between you and another client, member, participant or event attendee is voluntary and occurs independently of Catch Select.

You are responsible for your own:

• decisions;

• communications;

• conduct;

• arrangements; and

• personal safety when interacting with another person.

Catch Select does not control the conduct, statements, actions, intentions or decisions of clients, members, event attendees or other third parties.

Unless expressly agreed otherwise in writing, Catch Select is not responsible for arrangements made directly between you and another person, including:

• dates or meetings;

• travel;

• accommodation;

• purchases;

• gifts;

• financial arrangements;

• personal relationships; or

• other personal decisions.

You should exercise reasonable judgment and take appropriate precautions when communicating with or meeting another person.

10. Personal Safety

You are responsible for assessing your own circumstances and deciding whether to communicate with, meet or continue interacting with another person.

Catch Select encourages participants to take reasonable precautions appropriate to their circumstances, which may include:

• communicating carefully before meeting;

• meeting initially in an appropriate public location;

• informing a trusted person of your plans where appropriate;

• arranging your own safe transportation;

• protecting your personal and financial information; and

• ending communication or a meeting if you feel unsafe or uncomfortable.

Catch Select does not supervise private meetings or dates unless expressly agreed in writing.

You should contact appropriate emergency services if you believe that you or another person is in immediate danger.

You should report serious safety concerns relating to another Catch Select participant to us as soon as reasonably practicable.

11. Financial Scams, Exploitation and Fraud

You must not use Catch Select, an introduction or information obtained through our services to:

• request or solicit money;

• borrow money;

• pressure another person to provide financial assistance;

• promote an investment opportunity;

• solicit cryptocurrency or digital assets;

• request banking, financial or identity information;

• engage in fraud, deception or financial exploitation; or

• obtain any financial or commercial advantage through deception or coercion.

You must not pressure another participant to purchase goods, services, investments or other products.

Catch Select may immediately suspend, investigate or terminate participation where we reasonably suspect fraud, financial exploitation, deception or another serious risk to participants or our business.

12. Member and Participant Conduct

You must behave respectfully, responsibly and lawfully when using our services and interacting with Catch Select, our staff and other participants.

You must not:

• provide false, misleading or deceptive information;

• impersonate another person;

• provide fraudulent documentation;

• harass, threaten, intimidate or abuse another person;

• discriminate against another person unlawfully;

• engage in unwanted, inappropriate or unlawful conduct;

• engage in stalking or repeated unwanted contact;

• continue contacting another person after they have clearly requested that you stop;

• pressure or coerce another person into an introduction, meeting, relationship or other activity;

• share another person's personal information without appropriate authority;

• publish, distribute or misuse another person's photographs, profile information or private communications without appropriate authority;

• use information obtained through Catch Select to locate, monitor or contact a person outside the agreed introduction process;

• create fake profiles or accounts;

• use Catch Select for commercial, fraudulent or unlawful purposes;

• engage in conduct that may reasonably place another person at risk; or

• interfere with the operation, reputation or security of Catch Select.

Catch Select may investigate reports or concerns relating to participant conduct.

Subject to applicable law, we may take action that we reasonably consider appropriate, including:

• issuing a warning;

• restricting participation;

• suspending membership or services;

• cancelling an introduction;

• removing a person from an event;

• terminating services; or

• refusing future participation.

13. Privacy and Confidentiality

Your privacy is important to us.

We handle personal information in accordance with our Privacy Policy and applicable privacy obligations.

Catch Select does not publicly display member profiles unless we have an appropriate basis or permission to do so.

Personal information or profile information may be shared with a potential match where reasonably necessary to facilitate our services and in accordance with our Privacy Policy, consent processes and applicable law.

You must respect the privacy and confidentiality of other participants.

You must not, without appropriate authority:

• copy or distribute another person's profile;

• publish another person's photographs;

• disclose another person's contact details;

• share private communications;

• disclose information learned through Catch Select; or

• otherwise misuse another person's personal information.

You acknowledge that Catch Select cannot control information that you voluntarily disclose directly to another person.

You should exercise caution before sharing sensitive personal, financial or identifying information with another participant.

Our Privacy Policy forms part of the framework governing how we handle personal information.

14. Sensitive and Third-Party Information

Where Catch Select collects information subject to additional privacy or legal requirements, we will handle that information in accordance with applicable laws and our relevant policies.

You should not provide unnecessary sensitive information or personal information about another person unless:

• requested by Catch Select;

• reasonably necessary for the relevant service; or

• you have an appropriate basis to provide that information.

Where you provide information about another person, you represent that you have an appropriate basis to do so.

15. Fees and Payment

Fees for Catch Select services will be communicated to you before you purchase or commence a paid service.

Unless otherwise agreed in writing:

• all fees are payable in Australian dollars;

• applicable taxes may apply;

• payment may be required before services commence;

• package inclusions and service periods will be subject to the applicable service terms;

• you must provide accurate payment information; and

• you remain responsible for payment of agreed fees.

Catch Select may suspend or delay services where payment is overdue, subject to applicable law and the terms of your service arrangement.

Any additional costs that are not expressly included in your purchased service, such as meals, travel, accommodation, venue charges or purchases made during a date or event, are your responsibility unless Catch Select agrees otherwise in writing.

16. Packages, Memberships and Service Periods

The services included in a package or membership may be subject to specific:

• inclusions;

• exclusions;

• limitations;

• timeframes;

• eligibility requirements; and

• conditions.

These details will be communicated in the applicable package, membership or service agreement.
Unless otherwise agreed in writing:

• packages and memberships are personal to the client and non-transferable;

• services cannot be transferred to another person;

• unused services or benefits may expire at the end of the applicable service period;

• unused benefits are not automatically carried forward;

• Catch Select is not required to provide a replacement benefit unless required by law or agreed in writing; and

• extensions, pauses or variations are subject to Catch Select's agreement and applicable law.

A package does not guarantee a particular relationship outcome or the availability of a specific number of suitable matches unless expressly included in the applicable written service terms.

Where a package includes multiple introductions, the availability and timing of those introductions may depend on the availability of potentially suitable and mutually interested individuals.

If you enter an exclusive relationship, no longer wish to participate, become unavailable or materially change your circumstances, you should notify Catch Select as soon as reasonably practicable.

17. Cancellations, Changes and Refunds

Cancellation, rescheduling and refund arrangements may vary depending on the service, package, consultation or event.

Specific cancellation, rescheduling and refund terms may be provided at the time of booking or purchase.

If you wish to cancel or change a booking or service, you should contact Catch Select as soon as reasonably practicable.

Where permitted by law and the applicable terms, fees may take into account services already provided, work already performed, administrative costs or other reasonable costs associated with the booking or service.

Catch Select may cancel, reschedule or modify a consultation, service or event where reasonably necessary due to circumstances including:

• safety concerns;

• participant conduct;

• venue or supplier issues;

• insufficient attendance;

• staff unavailability;

• circumstances outside our reasonable control; or

• other legitimate operational reasons.

Where Catch Select cancels a paid service or event, any refund, credit, replacement service or other remedy will be determined in accordance with the applicable service terms and Australian Consumer Law.

Nothing in these Terms is intended to exclude, restrict or modify any right or remedy you may have under the Australian Consumer Law or any other applicable law.

18. Events and Social Experiences

Catch Select may organise, host or facilitate events, social experiences and other activities.

Event availability, eligibility requirements, locations, fees and participation conditions may vary.

By attending an event, you agree to:

• comply with reasonable instructions provided by Catch Select, venue operators or event staff;

• behave respectfully and lawfully;

• comply with applicable venue rules;

• take reasonable responsibility for your personal belongings and decisions;

• respect the privacy and boundaries of other attendees; and

• avoid conduct that may place yourself or another person at risk.

Catch Select may refuse entry to, remove from or exclude a person from an event where reasonably necessary for safety, security, operational or conduct-related reasons, subject to applicable law.

Third-party venues, suppliers and service providers may have their own terms and conditions, which may apply to you.

You are responsible for complying with those applicable terms.

19. Photography and Media at Events

Catch Select may arrange photography or videography at certain events.

Where photography or videography is taking place, we may notify attendees before or at the event.

Any collection, use or publication of identifiable images or recordings by Catch Select will be handled in accordance with applicable law, our Privacy Policy and any applicable consent process.

If you do not wish to be photographed or recorded, you should notify Catch Select where reasonably practicable. We will consider reasonable requests, but we cannot guarantee that incidental or background images can always be avoided.

Participants must not photograph, record or publish images of another participant in circumstances where doing so would breach privacy, confidentiality, event rules or applicable law.

20. Feedback

Catch Select may invite feedback following an introduction, event or other service experience.

Feedback may be used to:

• understand your experience;

• improve our services;

• refine future matchmaking considerations; and

• address concerns where appropriate.

Catch Select is not required to act on every item of feedback or provide a particular outcome as a result of feedback.

Any personal information contained in feedback will be handled in accordance with our Privacy Policy and applicable obligations.

21. Professional Advice Disclaimer

Catch Select provides matchmaking, introduction and related services.

Unless expressly stated otherwise, Catch Select does not provide:

• medical advice;

• psychological or mental health advice;

You should seek independent professional advice where appropriate.

You should not rely on Catch Select's services as a substitute for your own judgment, due diligence or personal safety precautions.

You must not use our website in a manner that is:

• unlawful;

• fraudulent;

• harmful;

• misleading;

• intended to interfere with the operation or security of the website; or

• intended to obtain unauthorised access to information, systems or services.

25. Events Outside Our Reasonable Control

Catch Select will not be responsible for a failure or delay in performing obligations where the failure or delay is caused by circumstances outside our reasonable control.

• public health emergencies;

• venue closures;

• transport disruptions;

• utility or technology failures;

• supplier failures;

• industrial action;

• serious illness or unavailability of key personnel; or

Where reasonably practicable, Catch Select may provide an alternative arrangement, reschedule a service or take other reasonable steps to address the disruption.

Nothing in this clause affects rights that cannot lawfully be excluded.

 

26. Limitation of Liability

To the maximum extent permitted by law, Catch Select is not liable for indirect, incidental, special or consequential loss arising from or connected with your use of our services or interactions with another participant.

To the extent permitted by law, Catch Select is not responsible for loss arising from:

• personal decisions made by you or another participant;

• inaccurate, incomplete or misleading information provided by another participant;

• communications between participants;

• the actions, conduct or intentions of another participant;

• private meetings or dates arranged between participants;

• financial arrangements or transactions between participants;

• a participant withdrawing from an introduction or service;

• a relationship not developing or ending;

• third-party venues, suppliers or service providers; or

• circumstances outside Catch Select's reasonable control.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded, restricted or modified.

Where liability cannot lawfully be excluded but may lawfully be limited, Catch Select's liability will be limited to the maximum extent permitted by applicable law.

27. Indemnity

To the extent permitted by law, you agree to indemnify Catch Select against reasonable losses, liabilities, claims, costs or expenses arising directly from:

• your unlawful conduct;

• your material breach of these Terms;

• your fraudulent or misleading conduct;

• your misuse of Catch Select's services; or

• your unauthorised use or disclosure of another person's personal information.

This clause does not require you to indemnify Catch Select for loss caused by Catch Select's own negligence, unlawful conduct or any liability that cannot lawfully be excluded or restricted.

28. Suspension and Termination

Catch Select may suspend, restrict or terminate your access to services where reasonably necessary, including where:

• you materially breach these Terms;

• you provide false or misleading information;

• you provide fraudulent documentation;

• you fail to comply with reasonable verification requirements;

• you engage in inappropriate, unsafe or unlawful conduct;

• you harass, threaten or seriously inconvenience another participant or staff member;

• we reasonably believe that your continued participation may create a risk to another person, our staff or our business;

• you engage in suspected fraud or financial exploitation; or

• continued provision of services is no longer reasonably practicable.

Where appropriate, Catch Select may provide notice or an opportunity to address a concern before taking action. However, we may take immediate action where reasonably necessary to protect safety, security, privacy or the integrity of our services.

Termination or suspension does not affect rights or obligations that accrued before termination or suspension.

Any consequences relating to fees, refunds or unused services will be determined in accordance with the applicable service terms and applicable law.

29. Complaints and Dispute Resolution

When raising a complaint, please provide sufficient information for us to understand and investigate the issue.

Nothing in this clause prevents you from exercising any rights or remedies available to you under applicable law.

You and Catch Select submit to the jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them, except where applicable law provides otherwise.

 

32. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be modified or severed to the extent necessary.

The remaining provisions will continue in full force and effect.

 

33. No Waiver

A failure or delay by Catch Select to exercise a right or remedy under these Terms does not constitute a waiver of that right or remedy.

Any waiver must be made in writing.

 

34. Entire Agreement

To the extent permitted by law, these Terms, together with:

• our Privacy Policy;

• any applicable service agreement;

• membership terms;

• booking terms;

• package terms;

• event terms; and

• any other applicable written agreement,

form the agreement between you and Catch Select in relation to the relevant services.

Where there is an inconsistency between these Terms and a specific written service agreement, the specific written agreement will prevail to the extent of the inconsistency.
